Terms of Service

1. Acceptance of Terms

By accessing or using PropertyWiz AI (“the Service”), operated by PropertyWiz AI (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PropertyWiz AI is a real estate investment analysis platform that provides property data, financial calculations, AI-powered insights, and related tools. The Service is designed for informational and analytical purposes to assist real estate investors and agents.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information during registration and to keep it up to date.

4. Subscription and Billing

The Service offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method at the beginning of each billing cycle.

You can cancel your subscription at any time to stop future charges from Manage Subscription in your account. After cancellation, your subscription remains active until the end of the current billing period, but we do not offer refunds or prorate unused time. This applies even if you forget to cancel before your subscription renews.

5. Free Trials and Promotions

We may offer free trials or promotional pricing at our discretion. At the end of a trial or promotional period, your subscription will automatically convert to a paid plan at the standard rate unless you cancel before the trial ends.

6. Pricing, Limits, and Plan Changes

We may adjust pricing, included features, usage limits, or plan structure as the Service evolves. For active paid subscribers, we will provide at least 14 days’ notice via email or in-app notification before any material change to your plan takes effect at your next billing cycle.

Where features are marked as “unlimited,” fair use applies: usage is expected to reflect normal individual professional use of the Service. We reserve the right to introduce reasonable usage caps, queue throttling, or rate limits without prior notice when usage materially exceeds typical professional use, threatens service stability, imposes disproportionate cost on the Service, or otherwise harms other users’ experience.

For Free tier users, included limits, features, and the availability of the Free tier itself may change at any time without prior notice.

7. Acceptable Use & Fair Use

You agree not to:

• Use the Service for any unlawful purpose
• Share your account credentials or your account access with others
• Create multiple accounts to circumvent free-tier limits, trial periods, or other restrictions
• Use bots, scrapers, headless browsers, or any other automation to access the Service or its third-party data integrations
• Attempt to reverse engineer, scrape, or extract data from the Service beyond normal use
• Interfere with or disrupt the Service, its infrastructure, or its third-party providers
• Resell, redistribute, or sublicense access to the Service without written permission
• Engage in usage that materially exceeds typical individual professional use or that imposes disproportionate cost on the Service (including but not limited to repeated high-volume API calls, mass property analyses, or AI feature usage well outside the patterns of other users on the same plan)

We reserve the right to throttle, cap, suspend, or terminate any account — paid or free, with or without prior notice — when we reasonably believe the account is engaged in any of the above. Termination for material breach of these terms does not entitle you to a refund of fees already paid.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and AI-generated outputs — are owned by PropertyWiz AI and are protected by intellectual property laws. You retain ownership of data you input into the Service.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or reliability of any data, calculations, AI-generated insights, or other information provided through the Service.

PropertyWiz AI is not a substitute for professional real estate, financial, legal, or tax advice. All investment decisions are made at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, PropertyWiz AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

11. Third-Party Services

The Service integrates with third-party data providers, APIs, and services. We are not responsible for the accuracy, availability, or reliability of third-party data. Third-party services are subject to their own terms and privacy policies.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting us.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
